COPYRIGHT POLICY

Action Photo Co., Inc. will not reproduce any images marked as copyrighted without a signed statement of permission and acceptance of responsibility.  In all cases, Action Photo Co., Inc. takes the position on unmarked material that the customer either owns or has proper permission from the owner to make reproductions.  The customer, by providing us with material for reproduction, agrees to hold Action Photo Co., Inc. and its assigns harmless for any penalties or damages that are assessed against us.

CLEANING ORIGINALS

Customer is responsible for submitting processed images in a clean condition.  You must also remove all extraneous materials (tabs, Mylar, sealed mats that inhibit processing, etc.)  An additional charge of $2.00 per item will be added to each piece that we must remove from a mat, mount or display board.  Mounts are often damaged during removal and will not be replaced.  Action Photo personnel will not perform any cleaning services to remove debris or fingerprints.  However, we do blow off surface dust with dried, conditioned, compressed air.  

FULL PRINT vs FULL NEGATIVE

35mm format negatives are not proportional to many print sizes, and some cropping may occur.  Please indicate your crops.  If you must have the complete image printed, please order “full negative” prints.

LIMIT OF LIABILITY

Submitting any film, print, slide or negative to this firm for processing, printing or other handling constitutes an AGREEMENT by you that any damages or loss by our company, subsidiary, or agents, even though due to the negligence or other fault of our company, subsidiary, or agent, will only entitle you to replacement with a like such replacement, the acceptance of the film, print, slide or negative is without other warranty or liability, and recovery for any incidental or consequential damages is excluded.

MIXED SIZE PRINTS FROM SAME NEGATIVE

The first print of any size from the same negative will be charged as an original.  As an example, an order is processed that includes two 8x10 and six 5x7 custom color prints.  The first 8x10 will cost $13.50 and the first 5x7 will cost $9.50, the remaining prints will be billed at the perspective rates for additional.

OPEN ACCOUNTS

Open accounts are available to qualified businesses.  Statements are mailed monthly and payment is due by the 25th of the following month.  Payment can be made by bankcards (MasterCard, Visa, American Express, or Discover), cash or check.

REMAKE POLICY

Request for remake or adjustment must be made within one week of receipt of order.  In order to consider adjustment, we must see both your original material and our reproduction.  Where a remake is approved, all prints must be returned.

RETURNED CHECKS

A $25.00 service charge will be assessed to all checks that are uncollectible each time the check is presented for collection.  In addition, to the service charge other collection costs may be added as permitted by Virginia Law.

RUSH CHARGES

Work processed outside of our published turn around times will be assessed a Rush Charge.  Such fees may vary from 100% to 300% of the base price for the affected service.

SHIPPING & HANDLING

All orders will be shipped per customer’s request.  Please specify shipper or preference.  Any shipping or handling charges are the responsibility of the customer.

Call Customer Service if you need a special size or quantity not listed in our price list.  You may also call to schedule a rush order.  Should a problem arise with an order do not hesitate to call.
